A federal judge in Miami allowed Timothy Hudson, 16, to remain free for now, despite being charged with killing and sexually assaulting his 18-year-old stepsister on a cruise ship.

The judge is considering whether to hold him in a juvenile facility, after prosecutors sought to place him in custody following a federal grand jury indictment in March.

Timothy allegedly killed and raped Anna Kepner in November 2025, while on a cruise with his family.

He has pleaded not guilty to the charges and is scheduled for trial in early September.

Prosecutors argue that Timothy is a danger to others and should be held in pretrial detention, while his lawyers sought a three-month continuance, citing the prosecution's 'voluminous' evidence.
