In a significant ruling, the Allahabad High Court has clarified that a proclamation under the Criminal Procedure Code does not necessarily bar an accused from seeking anticipatory bail. Presiding over the case, Justice Gautam Chowdhary granted bail to Monika, a nurse, who was charged with various offenses, including negligence and forgery, while working at a hospital. The court accepted her application despite a non-bailable warrant and a proclamation being issued against her, citing her pregnancy and the fact that she was unable to appear in court due to her condition. The charges against Monika were filed in November 2024, and she gave birth to a child just four days before the warrant was issued in October 2025. The court's decision underscores that each case is evaluated on its merits, and the issuance of a proclamation does not create a blanket ban on anticipatory bail applications.
