A Delhi high court division bench has ordered the resumption of eviction proceedings against the Delhi Race Club, which occupies 53.4 acres of land in the capital.
The court observed that a single judge's April 24 order, which restrained the estate officer from proceeding with the eviction notice, was passed without assigning reasons.
The showcause notice, issued under the Public Premises (Eviction of Unauthorised Occupants) Act, required the club to explain why an eviction order should not be passed regarding the public premises it occupied.
The court held that the single judge's order adversely affected the Centre's valuable statutory right under the PP Act, without recording reasons or rendering findings on essential considerations.
The dispute stems from the Centre's initial vacation notice to the club, which was later challenged in court and disposed of on April 9.
