Delhi HC Told Cutting GST on Air Purifiers Needs Long-Drawn Consultative Process: Centre

The Centre has opposed a plea to immediately reduce Goods and Services Tax (GST) on air purifiers, citing the need for a long-drawn consultative process. This decision comes as Delhi and surrounding areas grapple with severe air pollution. In a hearing at the Delhi High Court, the Centre argued that any reduction in GST rates cannot be decided in isolation. The court had earlier expressed concerns over the affordability of air purifiers, with prices often reaching ₹40,000. Additional Solicitor General K Venkataraman said that the GST Council would need to consider the proposal, involving multiple ministries, including finance and health. He also pointed out that the petition had broader implications, touching upon issues under the Drugs and Cosmetics Act, and that the Union Health Ministry should be involved. The Centre's opposition comes as a writ petition, filed by advocate Kapil Madan, seeks to reduce GST on air purifiers from 18% to 5%. The petition argues that air purifiers should be classified as 'medical devices' rather than luxury items, given the severe air pollution crisis in Delhi-NCR. The court had earlier directed the GST Council to hold an urgent meeting to consider reducing GST on air purifiers. However, the Centre has maintained that any decision requires a thorough consultative process. The court will continue to hear the case, with the Centre's submissions emphasizing the need for a more comprehensive approach.
