Supreme Court judge Justice Manmohan has expressed concerns over the impact of transfer fears on high court judges, stating that they can only function effectively when vested with full authority and independence.
Speaking at the 1st SCBA National Conference, Justice Manmohan emphasized that a high court judge should not work under the fear of transfer and must be adequately empowered.
His remarks come in the wake of the controversy surrounding the transfer of Madhya Pradesh High Court judge Justice Atul Sreedharan to the Allahabad High Court, which was seen as a move to undermine his seniority.
Justice Manmohan also called for a debate on the collegium system, citing mistrust and debate over the decision of a state high court's Chief Justice to recommend an individual for judgeship as a major challenge.
He further expressed concern over courts dealing with issues such as access to fresh air and clean water, which he believes should be addressed by the government rather than the judiciary.
Justice Manmohan also highlighted the lack of adequate judicial infrastructure at the grassroots level and lack of resources as key factors contributing to rising pendency in courts.
