Delhi HC Shields Sunil Gavaskar's Reputation, Orders Removal of Obscene Content

The Delhi High Court has taken a significant step in protecting the personality rights of former cricketer Sunil Gavaskar. In a recent ruling, the court restrained several websites and online platforms from using Gavaskar's name, images, or likeness for commercial purposes without his consent. The judge also ordered the removal of obscene content uploaded on the internet, with websites required to take down the offending material within 72 hours. Failure to comply may result in social media intermediaries removing the content. This development follows a previous order from the high court, which directed social media intermediaries to act on Gavaskar's plea within seven days. While some of the offending content has been removed, others still remain online. Gavaskar's lawsuit aimed to prevent unauthorized use of his name, images, and persona by social media platforms and e-commerce websites, and to protect his personality rights. The right to publicity, also known as personality rights, allows individuals to control and profit from their image, name, or likeness. This is not an isolated case, as several other celebrities, including Aishwarya Rai Bachchan, Hrithik Roshan, and Salman Khan, have also approached the high court seeking protection of their personality and publicity rights. The court has granted them interim relief, with further hearings scheduled for May 22.
