Supreme Court to Decide Fate of Unnao Rape Convict Kuldeep Singh Sengar's Sentence Suspension Today

The Supreme Court is set to hear a plea by the Central Bureau of Investigation (CBI) challenging the Delhi High Court's decision to suspend the life sentence of expelled former BJP MLA Kuldeep Singh Sengar in the high-profile Unnao rape case. A three-judge vacation bench, led by Chief Justice of India Surya Kant, will hear the matter on Monday. The CBI argues that the high court erred in declaring Sengar, who was an MLA at the time of the crime, was not a public servant and therefore not liable to be prosecuted under the Protection of Children from Sexual Offences (POCSO) Act. In its appeal, the CBI cited the L.K. Advani case, where it was ruled that public officials, including MPs and MLAs, are deemed public servants. The agency contends that the high court failed to consider Sengar's constitutional position and the responsibilities that come with it. The Delhi High Court had suspended Sengar's sentence in December, citing that he had already served seven years and five months in prison. However, the CBI's appeal seeks to overturn this decision and maintain Sengar's life sentence. The victim in the case has expressed faith in the Supreme Court's ability to deliver justice and has appealed to Uttar Pradesh Chief Minister Yogi Adityanath to ensure her safety, allowing her to fight her legal battle without fear.
