Supreme Court Quashes FIR Against Elvish Yadav in Snake Venom Case

YouTuber Elvish Yadav has been granted relief by the Supreme Court, which has quashed the FIR against him in the alleged snake venom case.

The case dates back to November 2023, when Elvish was booked for allegedly using snake venom at a rave party in Noida, Uttar Pradesh.

However, the Supreme Court held that the FIR could not be sustained in law, citing two specific legal issues.

The Court observed that the alleged psychotropic substance recovered from a co-accused was not listed in the Schedule of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Additionally, the Court pointed out that no recovery had been made from Elvish himself, and the charge sheet only suggested that he had placed orders through an associate.

The Court also highlighted that the Wildlife (Protection) Act requires prosecution to begin through a complaint filed by a duly authorised officer, which was not the case in this instance.

As a result, the Court ordered that the proceedings be quashed and granted liberty to the competent authority to initiate fresh proceedings if deemed necessary.
