The Assam Prohibition of Polygamy Bill, 2025, aims to safeguard women's rights and prevent exploitation. The legislation imposes a maximum punishment of 10 years' imprisonment for offenders, while parents, priests, and others who facilitate such marriages face up to two years' imprisonment. The new law prohibits individuals with a living spouse or whose previous marriage has not been legally dissolved from contracting another marriage. Concealing an existing marriage while entering into a subsequent one is also criminalised. Those entering into a polygamous marriage during the lifetime of their spouse may face up to seven years' imprisonment, while repeat offenders can face double the punishment. Chief Minister Himanta Biswa Sarma defended the legislation, stating that it is not against any religion but a step towards implementing a Uniform Civil Code in Assam. Sarma cited instances of elderly men marrying much younger women, causing immense suffering to women. He also highlighted the Quran's provision for monogamy as the law and polygamy as an exception. The bill provides compensation to women affected by polygamous marriages and empowers the state government to notify rules for enforcement. Convicted individuals will be barred from public employment, government-aided schemes, and contesting local elections in Assam. Local authorities, parents, and legal guardians who knowingly aid or conceal such marriages may face penalties. The law applies to Assam residents who enter into polygamous marriages outside the state and non-residents performing such marriages within Assam. Sarma clarified that the law excludes Scheduled Tribe (ST) communities and areas under the Sixth Schedule. The legislation is seen as a significant step towards protecting women's rights and promoting equality in Assam."
