Blank CD Scandal Rocks Rahul Gandhi's Savarkar Defamation Case: Pune Court Rejects YouTube Video Request

In a shocking twist, a Pune court has rejected a request to play a YouTube video as evidence in the defamation case against Rahul Gandhi, after a crucial CD submitted by the complainant was found to be blank. The CD had been played earlier before a different judge, but now it contains no data. The case, filed by Satyaki Savarkar, Vinayak Damodar Savarkar's grand-nephew, pertains to Rahul Gandhi's alleged 2023 defamatory speech about the Hindu ideologue. Judicial Magistrate (First Class) Amol Shinde is hearing the case. During the examination-in-chief of Satyaki, the CD containing the video of the alleged defamatory speech could not be played, revealing it to be blank. Despite this, Satyaki's lawyer requested to play an additional CD provided to the court, which was rejected as there was no record of it. The lawyer, Advocate Sangram Kolhatkar, claimed that when the case was registered in 2023, the original CD containing the alleged video was submitted as evidence, and the video played when it was submitted. However, now the CD shows no data. The special court for cases against MPs and MLAs also dismissed Satyaki's application to play the YouTube video of the alleged speech after the CD was found to be blank. The court relied on the Indian Evidence Act, citing that the certificate under Section 65B for the CD could not be applied to the YouTube URL. Magistrate Amol Shinde stated that the URL was not backed by a certificate under Section 65B, making it unacceptable as evidence. The court's decision has sparked controversy, with many questioning the credibility of the evidence presented in the case.
