CJI Gavai: Upbringing Led to Mercy in Shoe-Throwing Incident, Defends Collegium System

Former Chief Justice of India BR Gavai has spoken out about the shoe-throwing incident that occurred last month, revealing that his decision not to pursue action against the lawyer was influenced by his upbringing and personal values. In an interview with ANI, Gavai explained that he didn't even realize the incident was linked to alleged comments he made in court. The incident occurred on October 6, when Advocate Rakesh Kishore attempted to hurl a shoe at Gavai, who was in the courtroom at the time. Security personnel quickly intervened and removed the lawyer from the courtroom. Despite the incident, Gavai chose not to pursue any action against Kishore. Gavai also addressed criticism of the Supreme Court's collegium system, defending its transparency and functionality. He explained that the selection process involves extensive interaction and consultation with shortlisted candidates, consulting judges, and the law ministry. Gavai emphasized that all aspects are carefully considered before a final decision is made. In response to criticism of constitutional bodies, Gavai stated that cases are decided solely based on law and a judge's understanding of it. He welcomed fair criticism of judgments but emphasized that criticizing judges for their decisions is not in good taste.
