CPI(M) Slams Supreme Court for Allowing Governors to Hold Up State Bills

The Communist Party of India (Marxist) has expressed disappointment over the Supreme Court's response to a Presidential reference, arguing that it fails to curb the Centre's overreach into state powers. The top court's ruling, issued last week, stated that governors do not have unlimited power to delay state bills but can refer them to the President for indefinite consideration. The CPI(M) claims this decision will embolden governors to exercise extra-constitutional powers in opposition-ruled states, undermining state autonomy. The party specifically criticized the court's suggestion that a governor can refer a bill to the President after it is adopted a second time by the state legislature, effectively delaying its implementation. While the court allowed for limited judicial intervention in cases of prolonged inaction, the CPI(M) argues that the guidelines are ambiguous and do not provide sufficient checks on governors' arbitrary behavior. The CPI(M) views the Supreme Court's advisory as a missed opportunity to establish constitutional safeguards against the Centre's overreach.
