Delhi HC Quashes Case Against Gautam Gambhir Over Alleged Covid-19 Medication Stocking Scandal

The Delhi High Court has quashed a case against India cricket team head coach Gautam Gambhir and his foundation over allegations of unauthorised stocking and distribution of the Covid-19 medication Fabiflu during the pandemic's second wave. In July 2021, the Delhi Drugs Control Department registered a complaint against Gambhir, his family members, and the foundation's CEO, citing violations of the Drugs and Cosmetics Act. The complaint alleged that Gambhir and his team distributed Fabiflu without a valid licence, which is punishable by imprisonment and a fine. Gambhir contested the allegations, stating that he provided the medication free of cost to those in need and did not sell it for profit. He also argued that his family members were unfairly included in the complaint. The high court initially stayed trial court proceedings in September 2021 but vacated the stay in April this year. The Delhi Drugs Control Department had opposed Gambhir's plea, arguing that a trial was necessary to determine the validity of the allegations. In the end, the high court ruled in Gambhir's favour, quashing the case against him and his foundation. The decision comes as a relief to Gambhir, who had been summoned to appear in court in July 2021. The case highlights the complexities of regulating medication distribution during public health crises.
