Delhi HC Rejects PIL Seeking FIR in Staffer's Suicide, Promises Action Based on Audit Report

The Delhi High Court has refused to direct the registration of an FIR into the death of a 43-year-old administrative clerk who took his life by jumping from a building inside the Saket court complex. The court says it's awaiting a report from proceedings under Section 194 of the Bharatiya Nagarik Suraksha Sanhita, which are currently underway. In a public interest litigation, the court was asked to direct the police to register an FIR and fill up clerical vacancies. The bench, however, assured that the high court administration is taking steps to address the situation. The court has ordered an audit to assess the vacancy, occupancy, and requirement of clerical staff in district courts in the capital. Based on the report, the authorities will take action to fill up the vacancies. The deceased, Harish Singh Mahar, an ahlmad, had sought his transfer four times due to work pressure. His family was granted relief according to the law, and the court has promised to take adequate steps to address the issue of vacant posts in the courts. The court noted that the deceased was handling a significant workload, including 3,000 files, in a fully digitized traffic court. The court observed that while handling such a large number of files attracts attention, it's not necessarily true. The court has assured that a course of action will be taken within the shortest span of time to address the issue of vacant posts and work pressure on court staff. With over 3,000 posts of court clerks vacant, the court has promised to take adequate steps to fill up the vacancies at the earliest.
