Delhi HC Reserves Verdict in Sameer Wankhede's Defamation Suit Against Shah Rukh Khan's OTT Platform

The Delhi high court has reserved its verdict in a defamation suit filed by former Narcotics Control Bureau (NCB) officer Sameer Wankhede against Shah Rukh Khan's Red Chillies Entertainment and Netflix. Wankhede is seeking the removal of content from an episode of the series 'Ba***ds of Bollywood' that allegedly portrays him in a bad light. The series, created by Shah Rukh Khan's son Aryan Khan, features a character resembling Wankhede. Red Chillies and Netflix argue that the court lacks jurisdiction to hear the case, as Wankhede's residence and the company's registered office are in Mumbai. However, Wankhede's counsel argues that the principal harm has occurred in Delhi, where departmental proceedings against him are based and media outlets have approached him for interviews. In a key submission, Wankhede's counsel pointed out that an actor who played a character resembling him had allegedly admitted to doing so, stating 'I just did my job in representing you.' The court has framed two key questions for consideration: whether the suit is prima facie maintainable and whether the content in question is defamatory. A verdict is now pending.
