A special court in Uttar Pradesh's Noida has ordered the police to register a First Information Report (FIR) against a security guard accused of molesting an 11-year-old girl. The POCSO court's decision comes after the police initially closed the case, citing the accused's statement while ignoring the victim's testimony. The incident allegedly occurred on March 16, 2025, when the girl was returning from playing with friends near her apartment complex. The security guard, who was deployed at the site, allegedly lured her to an isolated spot and sexually assaulted her. He also made her take a selfie with him to imply her consent. The victim reported the incident to a lady guard, but her mother claims that the police, including the SHO of the Expressway Thana, pressured the family to agree to a compromise. The mother alleged that the SHO initially refused to accept their complaint and only registered it after much persuasion. Despite recording the victim's statement on May 1, 2025, the police did not lodge an FIR. The family then approached the Chief Minister's Grievance Portal, which prompted the Noida police to file a closure report. However, the report did not include the victim's statement. The POCSO court's order directs the police to lodge an FIR against the security guard and to investigate the involvement of other accused persons, including a member of the Apartment Owners' Association. The court's decision has been welcomed by the victim's lawyers, who expressed concern over the state administration's handling of sensitive complaints. "This case highlights the need for a robust and responsive system to handle complaints of sexual offences against children," said lawyer Sachin Jain. "It is deeply concerning that the state administration declines to entertain such sensitive complaints at the very outset.
