Tesla Wins Interim Trademark Injunction Against Indian Firm in Delhi High Court

In a significant move, the Delhi High Court has granted an interim injunction in favor of US-based electric vehicle giant Tesla Inc, restraining Indian company Tesla Power India from using the trademarks 'Tesla Power' and 'Tesla Power USA'. The court's order, passed on November 24, comes after Tesla Inc alleged that the Indian firm's use of its trademark could cause confusion among consumers and potentially harm its reputation. According to the court's 52-page order, Tesla Inc had approached the court seeking a permanent injunction to prevent Tesla Power India from using its trademark, logos, and domain names. The US-based company argued that its extensive international use of the TESLA trademark and prior registrations gave it exclusive rights to the mark. The court found that Tesla Power India's use of the 'Tesla Power USA' name was an attempt to mislead customers into believing that the Indian company was connected to Tesla Inc. The court also noted that Tesla Power India had no intention of manufacturing electric vehicles, adding to the confusion. The interim injunction bars Tesla Power India from using the 'Tesla Power' and 'Tesla Power USA' trademarks, as well as related domain names, until the final disposal of the suit. The court's order has been made available on its website and is a significant victory for Tesla Inc in its efforts to protect its trademark in India.
