A Thane court has sentenced a 38-year-old man to three years rigorous imprisonment for sexually assaulting a 12-year-old girl in 2017. The incident occurred on October 24, 2017, when the victim was alone in a residential lift in the Mira Road area of Thane district. The accused, a neighbour of the victim, entered the lift, closed the door, and committed the heinous crime. The victim immediately informed her mother about the incident, which was corroborated by her testimony in court. Judge D S Deshmukh, while delivering the verdict, emphasized the importance of dealing with such offences sternly to send a clear message to society. Despite taking a lenient view, considering the accused's family background and lack of criminal history, the judge imposed a sentence to ensure justice is served. The court also imposed a fine of ₹5,000 on the accused, which will be paid to the victim as compensation. The case has been recommended to the District Legal Services Authority for additional compensation to the victim. This judgment serves as a reminder that the reliability of a child victim's statement is crucial in sexual offence cases. The court has set a precedent by upholding the victim's testimony, which inspires confidence in the commission of the act. The Thane court's decision aims to give a clear message to society that such heinous crimes will not be tolerated and will be dealt with stringent punishment.
