KRK Banned from Spreading Defamation: Court Protects Vashu Bhagnani's Reputation

A Mumbai court has temporarily barred outspoken film critic Kamal Rashid Khan (KRK) from posting defamatory content against film producer Vashu Bhagnani. The court ruled that KRK's right to free speech does not outweigh Bhagnani's right to protect his reputation. Vashu Bhagnani filed a defamation suit against KRK in 2021, alleging a 'well-orchestrated smear campaign' through 'grossly defamatory' tweets and videos. Bhagnani sought a temporary ban on KRK posting further defamatory content until the defamation suit is settled. The court ordered KRK to delete or withdraw the 'offending allegations' but denied an unconditional apology, citing the need for detailed evidence typically handled at the final trial stage. In its ruling, the court emphasized that an individual's right to free speech should not infringe upon another's right to privacy and public image. KRK's defense claimed that as a film critic, he was merely exercising his right to review films and discuss industry trade, but the court found that his statements were affecting Bhagnani's right to privacy. Vashu Bhagnani, a 64-year-old film producer, has a 30-year career with hits like Coolie No 1 and Rehnaa Hai Terre Dil Mein. However, his production company has struggled with recent box office flops, including Ganapath and Bade Miyan Chote Miyan.
