CJI Gavai Warns Against Excessive Judicial Intervention, Calls for Balance in Rights Protection

In a recent address, Chief Justice of India B R Gavai emphasized the importance of judicial activism in safeguarding citizens' rights. However, he cautioned against its potential to become 'judicial adventurism or judicial terrorism'. The CJI noted that while the judiciary must step in when the legislature or executive fail to protect rights, there must be a balance in exercise of judicial power. The comment was made during the release of a book on law, justice, and the Constitution, authored by former Chief Justice of Allahabad High Court Justice F I Rebello. The CJI praised Justice Rebello's work, highlighting its value in guiding the judiciary, lawyers, and law students towards achieving social and economic equality. Supreme Court judge Justice Vikram Nath also spoke at the event, underscoring the significance of the book in addressing contemporary judicial challenges.
