HC Rejects Job Bid on Compassionate Grounds for Man Who Waited 15 Years for Father's Death Benefits

The Calcutta High Court has dealt a setback to a 23-year-old man who had been waiting for 15 years for a job on compassionate grounds after his father's death. Sayed Shahinoor Zaman's father, a school assistant headmaster, died in harness in 2010, leaving behind his eight-year-old son. Zaman's lawyer claimed that his mother had made a representation to the school authorities for a job on compassionate grounds, but it was not considered. However, the court observed that there was no document to prove that the application was made. Zaman later made a fresh application for the job when he turned 18, but it remains pending. The court ruled that compassionate appointments are meant to address immediate financial crises faced by families after the breadwinner's death, not to provide a job to the heir years later. Justice Amrita Sinha noted that the application was made 15 years after the father's death, and there is no scope to show compassion at such a belated stage. The court dismissed the petition, holding that there is no scope for reservation of vacancies to be filled up by the heir of the deceased upon attaining majority.
